An example in Canada is the Canadian Franchise Association (CFA); in the U.S., the International Franchise Association (IFA). Both associations review the franchisor's legal documents to ensure they conform to appropriate legal and ethical standards. The CFA even goes so far as to email all existing CFA members with the names of those franchisors looking to gain membership. If any CFA member has information to report on one of the prospects - good or bad - this is taken into account.

Legal Documents - There are stringent guidelines as to the details that must be included in the franchisor's franchise agreement and other legal documents to be provided to the franchisee. In Canada, all prospective candidates in Alberta, Ontario and some Maritime provinces must receive, in addition to the franchise agreement, a disclosure document detailing the franchisor's history, including any litigation, financials, and location closings. The requirements in the U.S. UFOC (Uniform Franchise Offering Circular) are even more precise, requiring a thorough account of every detail of the franchise agreement. Due to the legal intricacy of the documents, hiring legal counsel is advised.

Earnings Claims - Unless the franchisor specifically provides earnings claims in its UFOC or franchise agreement, no earnings claims can be made alluding to sales, income, or earnings potential for the prospective franchisee. Promises of success and income guarantees are thus often unethical and illegal.

Contacting Existing Franchisees - The above being said, you may contact existing franchisees for their sales perspectives. They may share this information with you, at their discretion. As a rule, it is always a good idea to contact existing franchisees. While each will have his/her own life circumstance and income goal in mind, they can give you an idea as to the honestly and integrity of the franchisor and its franchise system.

Resolving Disputes - Disputes inevitably come up between franchisee and franchisor. As long as the franchisor works with the franchisee or prospective franchisee to resolve a dispute, ethical standards are generally being practiced. Having your questions or concerns go unanswered or be ignored is another matter. Open communication between both parties is key.

Nevertheless, trust your instinct, hire legal counsel to review the franchise agreements, and get as much information as you can. Facing the 3 Giants That Hinder your Success

He made Brock crawl blindfolded across the field with a teammate on his back. There are times when Brock wanted to rest or stop, but the coach kept up a stream of positive talk and encouragement until Brock reached the end.

He would have never done it had he allowed himself to stop based on his perceived limits.

In being programmed for defeat, Brock is setting his team up for it. But after doing the death crawl, he was to change his whole attitude.

Have you set limits for yourself that you don’t even try to reach for your dreams because of these? At some point in your life, have you told yourself any of the following?

“I can’t do it.”
“I’m not really good at .”
“I am too young / old to do this.”
“It’s no use trying. I won’t get it anyway.”
“I’ll never get that .”
“It has always been like this.”

Sound familiar? You are not alone in this thinking.

But do you know what successful people do? They do not set limits for themselves. At some point, they may have thought any of the things mentioned above, but they are quick to replace it with a positive thought. In setting no limits and expecting only the best, they reach their dreams – sometimes, something even better!

So here’s the secret – you have no limits. Whatever you want, you can get. Facing the giants of life can be easy if you have the right mindset and attitude.

2) Facing the Giants of Disbelief.

This is related to your perceived limitations. But this is more along the lines of thinking “it’s too good to come true” or “it’s too ideal to happen.”

In the movie, Brock couldn’t believe that his team could actually win. But when he and his teammates got rid of this thinking, they were ready for great things to happen.

This is the secret – if you can’t believe the best will happen, then it probably won’t. But if you believe the best will happen, it probably will. Yes, it is that simple. So, expect and work for the best and nothing less!

3) Facing the Giants of Fear.

Of all the giants, this is probably the most powerful – and most paralyzing. Fear clouds the mind and twists perception. Fear makes the dark darker, the cold colder, the big bigger, and the small a giant. In succumbing to your fear, you actually give power to the person or situation you are afraid of.

To put fear in the right perspective, Jack Canfield and Mark Victor Hansen gave a very good definition of it:

Experiences
Appearing
Real

Yes, your fear is no more than fantasized experiences. The reality may be totally different if only you try. What’s the worst that could actually happen? Probably less serious than you think.

If for example, you are afraid to ask your boss for a raise, you probably think your boss believes you are too full of it and will tell you off. Worse, you can even get fired. But if you believe your performance merits a raise, why should you be afraid? You just might get it if you only ask. And even if you don’t, you will know the areas you have to improve on to get it next time.

Fear is actually normal, but don’t let it conquer you. Keep your mind clear. And though you fear, do it anyway – and be amazed with the results.

Facing the giants of perceived limits, fear and disbelief may not be easy at first; but placed in the right perspective, you may be surprised to know they are not giants after all – it is only you who gives them that power. · Have name tags for guests and Consultants. Make your guests feel special by placing a strip of bright ribbon under their stick-on name tag or using a different colored name tag. This will make them feel welcome. Name tags also help you remember names as your team continues to grow.

· Involve your team. Ask as many Consultants as possible, both new and established, to contribute by bringing a business tip or taking on a role in the meeting. Sharing the responsibility ensures higher attendance and gives a sense of ownership for the meeting. Their input also helps prepare them for their future role as leader.

· Be sure handouts are copied and in order. It is best to have them at each participant's chair. If there are late arrivals, they will make less of an interruption if they do not have to ask for the materials.

· Audio/Visual equipment (i.e., flip chart, white board, VCR, overhead projector) needs to be in place and ready to use.

· When possible, have a small product display. If there is time left at the end of the session, you can share product information.

· Plan to start your training on time and end on time. Do not wait for late arrivals. They will never learn to be on time if you adjust for them.

· Dress professionally. As a Leader, you play an important role in cultivating the Company image. Your words and actions will show others you treat your business as a business. The tone of the meeting is set by how you dress.

· Music can add excitement to your meetings. Ask a Consultant to supply the music before and after the Meeting. Select contemporary music for an upbeat atmosphere.

· Get yourself in an enthusiastic state before the Consultants enter the room. Your Consultants will pick up on it and it will carry over when they leave.

Your advertising has to be designed to state a position different from your competitors. You do this by creating a unique ad concept. Here's a simple brainstorming technique anyone can use. You can do this even if you don't consider yourself creative. Creativity is about taking the current way you look at things and turning it around to something different. Anyone can do it if given a little training. First, come up with your key point. This is the ONE thing you want your prospect to know after they've read your ad. Your key point could be your offer, something particular about your service, your unique selling point, or any benefit you want the prospect to know. Your entire ad is centered on the key point.

What to do if a creative idea isn't freely flowing out of your brain? Don't worry, even among creative people this is rarely the case. You have to initiate the creativity.

Start by writing down everything that comes to mind about your key point. Don't leave any ideas out. Silly ideas are encouraged. The more off the wall, the better. In fact, start by getting your craziest ideas down on paper.

Write down movies, songs, TV shows, cars, food, and products that associate with your key point. Write down some stories your clients have told you about the topic. Then, think of the biggest benefit your client could possibly get from your key point. Write every idea you can think of. There are no bad ideas at this point.

When you can't think of any more ideas, look over your list. Now it's time to enhance your ideas. Make them even more outrageous. You can always tone them down later. But for now, you're coming up with stuff that's bizarre.

Lastly, look over the list again. Take your ideas to the opposite end of the spectrum. Pick some ideas to make extremely conservative. Tone them down. This helps balance out your crazy ideas.

That's the basics. The more you practice it, the better you'll get. Try it the next time you create an ad. You'll get some great ideas.
